What kind of performances should be allowed?

Proof of age

  • Performances that are dangerous to the safety of the child employee will not be allowed.
  • If performance causes physical or emotional strain on the child, it will not be allowed.
  • If the parents or legal guardians of a child employee believe that the performance will harm the child in any way, they can ask the employer to stop the performance and refuse the child to perform.

    Keeping of sectoral derteminatin

    An employer must, by law, keep a copy of the sectoral determination or an official summary at the workplace and make it available to parents, legal guardians or agents of the child employee.

    When is the law broken?

  • An employer who does not follow any of the sectoral determination rules when employing a child, is guilty of breaking the law
  • It is an offense for an employer to assist anybody else to employ a child and ignore any of the rules of the sectoral determination.
  • An employer who does not wish to employ a child by contravening the rules of the sectoral determination cannot be discriminated against.
